How to Rebuff Hired Gun Labels Defeat the Devils Advocate Querrys

𝗛𝗼𝘄 𝘆𝗼𝘂 𝗰𝗮𝗻 𝗮𝘃𝗼𝗶𝗱 𝘀𝗼𝘂𝗻𝗱𝗶𝗻𝗴 𝗹𝗶𝗸𝗲 𝗮 "𝗵𝗶𝗿𝗲𝗱 𝗴𝘂𝗻":

Turn off the legal wrangling and speak only medicine

I've been retained as an expert witness 110 times

And many of the plaintiff cases I review lack merit

But the retaining attorney often hates hearing that

Thus begins a different type of advocacy

The Devil's advocacy 👿...

They begin "But Dr. Gutman..."

• Shouldn't they instead ...
• Let's say they did not know ...
• If instead they had been told ...
• Hypothetically they could have ...
• Are you sure it wasn't a breach to ...
• Assuming that XYZ happened first ...

It goes on and on and on and on

𝘽𝙪𝙩 𝙩𝙝𝙞𝙨 𝙞𝙨 𝙩𝙝𝙚 𝙛𝙖𝙨𝙘𝙞𝙣𝙖𝙩𝙞𝙣𝙜 𝙥𝙖𝙧𝙩 𝙤𝙛 𝙗𝙚𝙞𝙣𝙜 𝙖𝙣 𝙚𝙭𝙥𝙚𝙧𝙩

I shed my legal hat and put on my pure medicine hat

And either defend or attack the care provided

Based on the most fundamental of questions:

"𝙒𝙝𝙖𝙩 𝙬𝙤𝙪𝙡𝙙 𝙄 𝙩𝙚𝙖𝙘𝙝 𝙖𝙣 𝙖𝙣𝙚𝙨𝙩𝙝𝙚𝙨𝙞𝙖 𝙧𝙚𝙨𝙞𝙙𝙚𝙣𝙩?"

❌If I cannot justify the care rendered

❎I call out the breach in standards of care

✔️If I can justify the care rendered

✅I freely defend the medicine provided

Stick to the medicine to avoid the "hired gun" label

𝙅𝙪𝙨𝙩 𝙠𝙞𝙙𝙙𝙞𝙣𝙜 ... you'll be labeled that anyway

Thus you need to know the medicine

𝘼𝙣𝙙 𝙝𝙖𝙫𝙚 𝙨𝙩𝙧𝙤𝙣𝙜 𝙘𝙤𝙣𝙫𝙞𝙘𝙩𝙞𝙤𝙣𝙨
